The meeting started at 9:05 a.m. The Subcommittee discussed the following requests for waivers of the repayment of an overpayment:
A. Jose Jimenez (SERS) (member) � The waiver request was previously tabled at the Regulation and Overpayment Subcommittee meeting of March 5, 2018 to allow the Division to contact Social Security and obtain a detailed payment history. As a result of the receipt of both Social Security Disability and Family Income in combination with workers compensation payments there is an overpayment of the SERS disability benefit of $12,772.35.
Action: Mr. Coffey moved; Mr. Casella second to recommend to the Commission to table the request for a waiver of repayment of an overpayment until such time that requested information from the Office of Attorney General becomes available.
Unanimous decision.
Trustee Michael Carey entered the meeting at approximately 9:30 a.m.
B. Jackie Dagitz (SERS) (member) - Overpayment of $58,273.95 due to receiving a Social Security Disability award and not reporting it to SERS.
Action: Mr. Coffey moved; Mr. Carey second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Ms. Dagitz failed to meet all the statutory and regulatory requirements required for approval.
Unanimous decision.
C. Elaine Carvalho (MERS) (member) - Overpayment of $ 72,215.86 due to the receipt of a MERS pension while re-employed in a participating municipality from January 10, 2017 through November 30, 2018 and therefore not being in compliance with relevant statutes following a Connecticut Superior Court decision on January 4, 2016.
Action: Mr. Coffey moved; Mr. Carey second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as the facts of evidence are not in the favor of approving the request.
Unanimous decision.
D. Ana Crespo (MERS) (member) - Overpayment of $135,004.49 due to the receipt of a MERS pension while re-employed with a participating municipality from January 1, 2015 through November 30, 2018 and therefore not being in compliance with relevant statutes following a Connecticut Superior Court decision on January 4, 2016.
Action: Mr. Casella moved; Mr. Coffey second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as the Trustees were unable to discern hardship.
Unanimous decision.
E. Eileen Rotchford (MERS) (member) - Overpayment of $12,478.26 due to receipt of a MERS pension while re-employed in a participating municipality from January 1, 2015 through November 30, 2018 and therefore not being in compliance with relevant statutes following a Connecticut Superior Court decision on January 4, 2016.
Action: Mr. Cary moved; Mr. Coffey second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as the Trustees were unable to discern hardship.
Unanimous decision.
