Meeting of the Legal & Personnel Subcommittee of the State Employees Retirement Commission

 

DATE:  October 10, 2018 

PRESENT: Chairman Peter Adomeit Trustee Michael Carey Trustee Charles Casella Commission Counsel Cindy Cieslak (Rose Kallor, LLP) Commission Tax Counsel Bruce Barth (Robinson & Cole LLP) Commission Tax Counsel Alisha Sullivan (Robinson & Cole LLP)

The Chair called the meeting to order at 8:32 a.m. 

At 8:32 a.m., Charles Casella moved, seconded by Michael Carey to approve the agenda.  All voted in favor. 

At 8:32 a.m., Chairman Adomeit called for new business.   

At 8:32 a.m., Charles Casella moved, seconded by Michael Carey, to enter into executive session for the purpose of discussing item nos. 1-15 on the agenda for executive session.  All voted in favor.  Attorneys Cieslak, Barth and Sullivan were invited into executive session. 

 

Executive Session - discussion and possible recommendation

  1. Determination letter and vcp status - written legal opinion.
  2. Equity refunds - written legal opinion.
  3. Conn. Gen. Stat. § 5-192b interpretation - written legal opinion.
  4. Statute of Limitations regarding overpayments - written legal opinion.
  5. SERC role in finalizing contracts - written legal opinion
  6. Joseph Etim - pending claim.
  7. Catherine Crandle - pending claim/written legal opinion.
  8. Jeremy Wiganowske - pending litigation. David Carter - pending litigation.
  9. Richard Kay - pending litigation.
  10. Town of Thompson - pending litigation.
  11. Carol Walenski - pending litigation.
  12. Ronald Johnson - pending litigation. Gary Soracchi - pending litigation.
  13. James Rizzio - pending litigation.

At 9:22 a.m., Charles Casella moved, seconded by Michael Carey, to come out of executive session. All voted in favor.

No recommendations were made regarding matters discussed in executive session.

At 9:22 a.m., Chairman Adomeit asked if there was any old business to discuss. 

The Subcommittee discussed the pending request for an update from the Retirement Services Division regarding the CMERS annual surveys regarding reemployment.

Chairman Adomeit also advised that he was in process of planning the Commission’s holiday party.  He asked the Subcommittee members for recommendations for the date and location for the gathering. 

MEETING ADJOURNED:  At 9:26 a.m., Charles Casella moved, seconded by Michael Carey, to adjourn.  All voted in favor.  Meeting adjourned.
