At 8:30 a.m. the meeting was called to order with Messrs. Blum, Coffey and Carey attending telephonically.
Mr. Casella moved, seconded by Mr. Carey to enter into Executive Session to discuss pending litigation (Brown v. SERC and Sampieri v. SERC) and legal strategy related thereto with Attorney Michael Rose in attendance. Motion passed unanimously.
At 9:52 a.m. the Subcommittee returned to regular session. No motions were made or action taken while in Executive Session.
At 9:53 a.m. Mr. Coffey moved, seconded by Mr. Casella to recommend that the Retirement Commission defer to the Court ruling in Sampieri v. SERC (administrative appeal) and proceed with considering a declaratory ruling as directed by the Court. Motion passed unanimously.
Mr. Carey moved, seconded by Mr. Casella to retain the law firm of Rose Kallor, L.L.P. to represent the State Employee's Retirement Commission in the lawsuit filed by Virginia Brown, subject to any necessary approval by the Attorney General. Motion passed unanimously.
At 9:54 a.m. Mr. Carey moved, seconded by Mr. Casella to adjourn. Motion passed unanimously
