MEMORANDUM NO. 2000-27a

Subject: Correction to Memorandum No. 2000-27, Protective Services (NP-5) Award
July 1, 1999 through June 30, 2004
  1. AUTHORITY
The collective bargaining arbitration award between the State and the Protective Services Bargaining Unit, which was approved by the State Legislature on April 27, 2000.
  1. PURPOSE
The purpose of this memorandum is to correct the memorandum dated May 12, 2000. The date for calculation of interest payments was stated incorrectly and information concerning retroactive holiday pay and shift differential is included.
  1. CORRECTION
Interest Payment: Retroactive payments not made in the June 2, 2000 check are subject to 5% unreportable interest after April 5, 2000. The date was incorrectly stated as June 4, 2000 in the previous memo.
 
Retroactive Holiday Pay: Article 25, Section 3(3), now provides that an employee who works on a holiday as part of his/her regular schedule shall receive pay at time and one-half for all hours worked on the holiday in addition to a compensatory day off. Employees who worked on a holiday as part of their regular schedule after July 1, 1999, and received straight time pay for hours worked, are entitled to the additional half time pay for such hours.
 
There is a Christmas exception where the employee receives time and one-half pay for hours worked and also receives straight time (for eight hours) in lieu of a compensatory day.
 
Under the prior Agreement, a compensatory day for a holiday worked as part of a schedule was on an hour for hour basis. Under the new contract all compensatory days for holidays are eight hours.
 
Retroactive Shift Differential: Please note that the change in the method of paying Shift Differential in Article 36, Section 1, may result in a retroactive payment for shift differential. This information was not included in the Retroactive Payment Schedule of Memorandum No. 2000-27 but it is included in the Payroll Procedures for Retroactive Salary Payments.
 
Such additional pay made after June 2, 2000 is subject to the interest payment described above.
  1. PAYROLL PROCEDURES
Agencies should calculate the interest payment as follows:
 
Multiply the employee's retroactive salary payments by the number of days between April 5, 2000 and date of payment of retroactive salary divided by 360, then multiply the product by 5%.
 
Interest payments will be identified as INTRST ARB AWD using D/OE Code 1U.
 
Retroactive holiday payment should be made as follows:
