SUBJECT: | 2003 EARLY RETIREMENT INCENTIVE PROGRAM FOR MEMBERS OF THE STATE EMPLOYEES RETIREMENT SYSTEM - EXCLUSION OF PART-TIME INSTRUCTORS |
Retirement & Benefit Services Division (Division) Memorandum dated March 7, 2003 discussed the 2003 Early Retirement Incentive Program (Program) for members of the State Employees Retirement System (SERS) enacted by the General Assembly and ratified by the Governor as part of the deficit mitigation plan for the Fiscal Year 03 (Public Act No. 03-02).
On March 28, 2003, Special Act No. 03-2 was passed, and became effective on that date. In part, the provisions of Special Act No. 03-2 exclude part-time instructors at institutions of higher education from participation in the Program. For the purpose of administering the Program, a part-time instructor means a SERS member whose state employment immediately preceding retirement consists exclusively of part-time teaching duties continuing on a semester by semester basis. Such intermittent employment does not carry with it access to other employee benefits routinely associated with permanent state employment. These part-time instructors shall not be eligible for the three incentive years provided by the Program.
The restriction from participation in the Program imposed by Special Act No. 03-2 has no impact on the Program eligibility of SERS members who are permanent state employees and also hold secondary positions as part-time instructors in higher education.
Please ensure that your part-time lecturers, adjunct faculty and like part-time instructors understand that they are not eligible to retire under the 2003 Early Retirement Incentive Program.
