Subject: | Provisions of Arbitrated Award for Mandatory Overtime for District 1199 |
I. PURPOSE
To provide agencies with instructions for implementing an arbitration award for District 1199 members which reverses an earlier determination not to pay double-time to full-time employees until they exceeded a threshold of forty (40) hours of work.
II. AUTHORITY
Article 13, Section 13 (A) of the contract between the State of Connecticut and the New England Health Care Employees Union, District 1199 and the recent arbitration award discussed in OLR General Notice No. 2003-22 dated July 25, 2003.
III. MANDATORY OVERTIMEArticle 13, Section 13 (A) defines the conditions when mandatory overtime may be utilized: weather emergency; event where the Governor closes state offices; lockdown in Corrections; when actual staff reporting to work is below minimum safe levels or legal requirements. Mandated overtime is experienced when the mandatory condition is imposed beyond the employee's regular shift, without regard to the forty (40) hour threshold.
