The meeting started at 1:14 p.m.

The Subcommittee discussed the following requests for waivers of the repayment of an overpayment.

James Fewell (MERS) - (member)
Overpayment due to receiving a workers compensation benefit

Action: Mr. Coffey moved; Mr. Caliendo second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Mr. Fewell failed to meet all the statutory and regulatory requirements required for approval. Unanimous decision.

Francis Light (MERS) - (member)
Overpayment due to receiving a workers compensation benefit.

Action: Mr. Culley moved; Mr. Coffey second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Ms. Light failed to meet all the statutory and regulatory requirements required for approval. Unanimous decision.

Louis Rascoe (MERS) - (member)
Overpayment due to receiving a workers compensation benefit.

Action: Mr. Coffey moved; Mr. Culley second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Ms. Light failed to meet all the statutory and regulatory requirements required for approval. Unanimous decision.

Wanda Hoyle (SERS) - (member)
Overpayment due to receiving a social security disability benefit

Action: Mr. Culley moved; Mr. Coffey second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Ms. Hoyle failed to meet all the statutory and regulatory requirements required for approval. Messrs. Caliendo, Coffey, Culley voted in favor of the motion - Mr. Casella abstained.

Luis Santana (MERS) - (member)
Overpayment due to receipt of social security disability benefit

Action: Mr. Coffey moved; Mr. Caliendo second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Mr. Santana failed to meet all the statutory and regulatory requirements required for approval. Unanimous decision.

Carol Corthouts (MERS) - (surviving spouse of a member)
Overpayment due to receipt of social security disability benefit

Action: Mr. Coffey moved; Mr. Caliendo second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Ms. Corthouts failed to meet all the statutory and regulatory requirements required for approval. Unanimous decision.

Maria Sevivas (MERS) (member)
Overpayment due to MERS service credit calculation.

Action: Mr. Coffey moved; Mr. Casella second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Ms. Servivas failed to meet all the statutory and regulatory requirements required for approval. Unanimous decision.

Julio Santiago (MERS) - (member)
Overpayment due to receiving a workers compensation benefit.

Action: Mr. Coffey moved; Mr. Caliendo second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Mr. Santiago failed to meet all the statutory and regulatory requirements required for approval. Tie Vote: Messrs. Coffey and Caliendo voting in favor of the motion: Messrs. Casella and Culley voting against.

Ronald Shepard (MERS) - (member)

Overpayment due to receiving a workers compensation benefit.

Action: Mr. Coffey moved; Mr. Caliendo second to recommend to the Commission to deny the request for a waiver of repayment of an overpayment as Mr. Shepard failed to meet all the statutory and regulatory requirements required for approval. Tie Vote: Messrs. Coffey and Caliendo voting in favor of the motion: Messrs. Casella and Culley voting against.
