Minutes of the July 8, 2014 Meeting

The meeting began at approximately 2:40 p.m.

Requests for Waiver of Overpayments
Diane Bahamundi (SERS) - member -
Failure to report receipt of Social Security Disability
Action: Mr. Casella moved, Ms. Mandour seconded to recommend denial of the
waiver request due to failure to report the receipt of Social Security
Disability. Unanimous decision.
Carol Gauthier - (SERS) - member -
Administrative Error
Action: Ms. Mandour moved, Mr. Casella seconded to recommend approval of the waiver based on hardship and administrative error. Unanimous decision.
Mr. Coffey moved and Mr. Carey seconded that the question on applicability of
the six (6) year statutory limitations to cases that arise under the regulations
to grant a waiver in hardship cases be referred to the Commission Counsel in
reference to cases that appear before the Regulations and Overpayment
Subcommittee. Unanimous decision.
Diana Joiner - (CMERS) - member -
Failure to report receipt of Social Security Disability
Action: Mr. Coffey moved, Mr. Carey seconded to deny due to failure to
report receipt of Social Security Disability. Unanimous decision.
Robin Peoples - (SERS) - member -
Failure to report receipt of Social Security Disability
Action: Mr. Casella moved, Mr. Coffey seconded to deny the request for
waiver due to insufficient information on the claim for hardship. Unanimous
decision.
Kathleen Proctor - (SERS) - member -
Failure to report receipt of Social Security Disability
Action: Mr. Coffey moved, Mr. Carey seconded to deny request of waiver
did not meet all the statutory and regulatory requirements required for
approval. Unanimous decision.
Outstanding Overpayments - requests for write-off
Discussion centered around two previous requests for write-off from the
Retirement Services Division - John Knapp and Maureen Ayrton, deceased retirees
with outstanding overpayments. Mr. Coffey moved, seconded by Mr. Casella to have
the Division contact the Attorney General's Office to see if there are any
options to handle recovery of the overpayments at this point in time. Unanimous
decision.
Copies of the Accounts Receivable Reports for both the State Employees Retirement System (SERS) and the Municipal Employee Retirement System (MERS) for fiscal year ending June 30, 2014 were distributed at the meeting. Copies will be provided to the Retirement Commission at the July 17, 2014 meeting.
